The aviation industry operates in a complex, highly regulated environment where safety and compliance are paramount.

At the 78th Association of South Pacific Airlines (ASPA) General Session, I shared insights on adapting to a new approach to regulatory compliance and safety oversight, highlighting opportunities for both regulators like CASA and industry to work collaboratively toward safer, more efficient operations.

The Aviation Regulatory Landscape: A Shared Responsibility

As noted in The Economist (September 2021), regulators set the environment, while industry creates value within it. CASA’s Flight Operations Regulation (FOR) transition, now over three years in, exemplifies the shift toward purposive, outcomes-based regulations. Operators are tasked with understanding their operational risks and documenting the operational systems to achieve safe outcomes in their Exposition. However, challenges like inconsistency and perceptions of regulatory overreach persist. This underscores a shared responsibility: regulators must provide clarity and flexibility, while industry must seize opportunities to innovate within the regulatory framework.

A Systems-Based Approach: The Four Ps

Aviation is inherently a system, and regulations often require operators to develop systems to achieve compliance. By adopting a systems-based approach—guided by the Four Ps (Policy, Procedures, Practices, Proficiency)—operators can answer critical questions: What are we doing? How are we doing it? When/Where does it happen? Who is responsible? This framework not only ensures compliance but also uncovers efficiencies. For example, in recent advisory work, a first-principles review using the Four Ps helped an experienced Part 135 Air Transport operator improve operational systems to achieve key approvals while assuring their Board of ongoing compliance with CASA requirements.

The Way Forward: Proactive Collaboration

The question isn’t just whether regulators like CASA should drive change, it’s whether industry is ready to take a proactive role. By viewing compliance as integral to business planning and sustainability, operators can enhance operational flexibility, innovate processes, and strengthen safety outcomes. This proactive systems-based strategy builds resilient operations that align with both current and emerging regulatory standards.
